Kolkata: Calcutta High Court on Friday directed the state government to file a report by December 6 on whether or not its order dated July 19, 2019 on illegal coal trafficking and eviction of encroachers in the Durgapur-Raniganj belt has been executed.
The court had directed the state to “depute an officer who would be worth his salt” to execute its order. The direction was issued by the division bench of Chief Justice TBN Radhakrishnan and Justice Arijit Banerjee. The July 19 order was also issued by this division bench.
The order further directed the state “to empower that officer with adequate powers under the code of criminal procedure (CrPC) and the Public Premises (Eviction of Unauthorized Occupants) Act, 1971 and several enabling provisions which will ensure that police laws of the state will be pushed up to its hilt to ensure that public properties involved in this petition are appropriately secured.”
The court order further states that “if the state police is unable to provide adequate support, notwithstanding the availability of CISF in the Eastern Coalfield Limited (ECL) premises, it will be open to the competent authority to request for the employment of central force or other available forces, as may be necessary.”
