Mumbai: Can’t blame auto driver for fatality if road is bad, says court
MUMBAI: Observing that due to “rough roads” the possibility of an accident even without the fault of the driver cannot be ruled out, a magistrate court recently acquitted an autorickshaw driver 11 years after he was accused of killing a senior citizen passenger by his zigzag driving in Aarey Colony.
“…the road on which the accused was driving the autorickshaw was rough. Due to such a road, the driver cannot run the vehicle smoothly. Further, due to such a road, the possibility of an accident even without the fault of the driver cannot be ruled out,” the court said.
