GMR vs Sepco: SC dismisses Chinese firm appeal in Rs 1,100 crore Odisha thermal power plant case

The Supreme Court on Friday upheld an Orissa High Court decision that quashed a 2020 arbitral award that asked GMR Kamalanga Energy to pay Rs 1,100 crore to Chinese construction contractor Sepco Electric Power Construction Corp.

Dismissing the Sepco appeal against setting aside of the Rs 1,100-crore foreign arbitral award that it had won, a Bench comprising Chief Justice BR Gavai and Justice Augustine George Masih said that the HC had “rightly” set aside the arbitral award as “a discriminatory treatment was meted out by the arbitral tribunal to GMR as against Sepco and that the arbitral award amounted to modification of the contractual terms.”
