As recently as last week he was in the ICUat our hospital. “I submit that we have paid significant amounts of money through sale of assets including our personal residence to satisfy the decree. I earnestly request your office to kindly intervene in the said matter and appoint a senior manager who has deci- sion making power to look into the matter and hear us out with complete non-bias. “There is no point in dealing with the lawyers appointed by your Bank as my family has already initiated proceedings against them for their various wrongdoings. Now another law firmbeing controlled byKAshar has stepped in since we have filed proceedings against them. In fact, they are nowmoving the courts again to issue arrest warrants against us on 29 Janu- ary. “I hope you can get your offi- cials to constructively meet us and resolve this issue. It is unbe- coming of your lawyers to ask for arrest of an 85 year old man suffering frommultiple diseases in order to settle personal scores and benefit our rival group. I can be reachedanytime. After 12 days of Ms Charu's let- ter, a response dated May 6, 2024 was sent by a junior official of the bank from Chennai office that no such request can be entertained as she was not the customer of the bank. The letter states, “In this regard, you are aware that you are not a party to R.P. No. 709 of 2004 case pending before DRT or any of the proceedings arising therefrom and therefore, we are not in a position to respond on matters related to our customer with any third-party personnel (pg 35). And within two weeks of that letter, the creator of the prestigious hospital, Mr Kishor passed away on May 20, 2024 in ICU, in deep phys- ical andmental pain. The hitman banker had denied him the dignity of resolution and ensured that his last living days on earth is filled with deep stress and anxietywhilst being in the ICU. “What is more shocking is that on 17.04.2024 the lawyers representing your Bank were making false statements before the Bombay High Court that my Husband is attending functions and events, whereas in reality, since past many months, he was battling for his life and has pres- ently undergone a serious ampu- tation surgery on his foot. Her above letter in full is scanned at pg 31 to 34. The said letter was accompanied by medical certificate from senior doctor of the hospital attending toMr Kishor (pg 35). Each and every word of this let- ter is searing in facts. But, even this letter did not change anything. Mr Sashidhar was not interested in resolution and recovery, but arrest and only arrest. She had to write this letter as her son's Rajesh Mehta's letter dated January 24, 2024 to Mr Sashidhar did not evoke any response from the bank. In his letter Mr Rajesh also raised similar issues and sought his intervention to resolve the issue instead of focussing on the arrest of his 86 year father, Mr Kishor. The relevant parts of his letter has been reproduced below: - “The astonishing part is that, a law firmnamedK. Ashar &Co. was appointed by the Legal Department of your Bank, to pursue the Recovery Proceed- ings against me and my father personally. This K. Ashar & Co. is the same law firm who has represented our rival group in the LKMM Trust litigation mat- ters. “Since the time of entry of this law firm acting as your Legal Representatives before the Debt Recovery Tribunal, the attacks on us have become personal and pointed to such a degree that the said lawyers used falsified and f r a u d u l e n t i n f o r ma t i o n received from our rival group to obtain arrest warrants against me and my father in the Recov- ery Proceedings to assist our opponents in the LKKM dispute.
