Sports City Scam Infra LIVE July 15, 2022 22 www.infralive.com structure in connivance with the officials of the Noida Authority, over the years, into 30 sub plots and handed over them initially to their subsidiaries who in turn later on passed on the ownership, in many cases, to third parties. Out of the total available area of 907,988 sqm, ATS group or its subsidiaries have taken 8 sub -plots admeasuring 303,711 sqm (75 acres) land. In Plot SC-01/A1, ATS Housing Pvt Ltd has already com- pleted ATS Pristine Phase 1 and obtained the completion certificate from the Noida Authority. How- ever, the sports infrastructure (Swimming Centre at the mini- mum cost of Rs 50 crores and multi-purpose hall including gym- nastic, badminton, table tennis, squash, basketball, volleyball & rock climbing at the minimum cost of Rs 30 crores) included in the Plot SC-01/A1 in layout plan approved by the Noida Authority in April 2015 have not been developed as stipulated. It is observed that the promoter has simply constructed a club house and swimming pool for the residents at the designated place. It is therefore not clear as to how the officials of the Planning wing of the Noida Authority have issued the completion certificate when the sports infrastructure of international sporting standards has not beendeveloped. Other prominent sub-allottees are: Ace Infracity Developers Pvt Ltd getting two sub-plots SC-01/A5 (23,050 sqm) and SC-01/B8 (45,604 sqm), Contend Infrastruc- ture Pvt Ltd has got Plot SC-01/B2 (80 , 932 sqm) , and Es the t i c Buildtech Pvt Ltd Plot SC-01/A4 (56,652 sqm). Ace Infracity has completed the residential project Ace Golf-shire whereas other pro- jects are under construction. None of the sub-allottees have developed any sports infra of international standards. As per the shareholding pattern given in detail at pg 32 to 61, Logix group has retained a total of 63,061 sqm(6.95 pc of total area) only with itself spreading across three plots: SC-01/A (5,189 sqm), SC-01/C-A3 (13,357 sqm) and SC-01/C-A9 (44, 515 sqm) as aga ins t the requirement of minimum 30 per cent stipulated in the Brochure. It is pertinent to point out that the divi- sion below 8,000 sqm was not allowed, and therefore SC-01/A divisionwas not permissible. In the case of SC-01/A, LBPPL outsourced the development work to Ace Infracity Developers Pvt Ltd on February 11, 2019 and has regis- tered a project called Ace Medley Avenue with UP RERA. However, there is no construction activity on the remaining two plots of LIPL SC- 01/C-A3 and SC-01/C-A9. Golf CourseAcreage If you are developing an 'interna- tional standard 9-Hole Champion- ship Golf Course with Driving Range', you need 65-75 acres of member and/or relevant member and/or SPCs put together were required to construct on their own a minimum of 30 per cent of the total permissible FAR on allotted area. However, initially the Logix Con- sortiumdivided (January 2012) the available plot of land admeasuring 548,192 sqm into two parts viz SC- 01/A admeasuring 269,430 sqm in favour of LBPPL and SC-1/B admeasuring 278,762 sqm in favour of LIPL. In violation of the brochure conditions, the Logix group did not give any share to other five members of the consor- tium including lead member in the sub-plot SC-01/A whereas three relevant members (Noida Cyber Park Pvt Ltd, IT Enfraservices Pvt Ltd and Lakshmi Constructions) of the consortium were not given any representation in the SPC that held plot No. SC-01/B. Thus, it can be said that compa- nies from diverse areas came together for a transitory period and helped otherwise ineligible consor- tium to qualify for allotment and after formal allotment was in place, they exited the consortium. Thus, the very purpose of creating con- sortium for pooling resources to achieve the prime objectives got defeated.
