Thereaf- ter, the directors of LIPL and Nobility executed the sub-lease deed on May 21, 2014 and got it registered before Sub-Registrar, Noida II on the same day. It was therefore evident that Logix Infra while seeking the approval of Noida Authority for allotting the plot to its subsidiary Nobility in April 2014, sub-leasing and registering the sub-lease of the plot to Nobility before Sub Regis- trar, Noida II in May 2014, had misrepresented and misled them by using a letter of theROC, Kanpur fraudulently obtained on April 22, 2014 declaring Nobility as a subsidiary of LIPL for claiming exemption from stamp duties/ registration charges and thereby causing loss of significant revenue t o t he gove rnment o f Ut t a r Pradesh. Noida Authority should declare the sub-lease agreement of the Plot No. SC-01/ CA-1 admeasuring 80,937 sqm executed between Nobility and Logix Infra onMay 21, 2014 as null and void and takeover the possession of the said plot. The UP government and Noida Author- ity should prosecute all the then directors of Nobility and LIPL and also recover the stamp duties payable on executed sub-lease deed along with 18 per cent interest per annum from the date of sub-lease to the date of payment. RERA inspection team has found in February 2022 that the Phase 1 of the ATS Grandiose launched in 2016 was still incom- plete, though the validity of the sanctioned plan of the project was long over in October 2021. The Phase II of the Project was regis- tered with UP RERA in September 2017 with March 30, 2018 as the date of start of the project. It is likely to take at least two and half years to get completed. It was therefore evident that the control of allottee over the plot was handed over to third party within a few months of the execution of the lease in favour of the allottee. The Allottee has therefore acted as a trader/ middleman of the plot and caused irreparable loss to the Noida Authority and state exche- quer.
