When Logix group handed over the project to ATS in 2014, no develop- ment had happened on the site. Now, on this site, a huge residential complex has come up which has been branded as ATSPristine. BRYSBUZZ Neo Infrastructure Pvt Ltd (inc 16.11.2012) This plot measures 28,326 sqm. LBPPL sub-leased this plot to its own group company - Neo Infra- structure Pvt Ltd. The company was incorporated by two individu- als - Vikram Nath and Devandra Saxena having 50 per cent equity each. However, on July 13, 2013, Neo entered into a collaboration agreement with Brys International Pvt Ltd (Brys Group) under which 10 per cent share along with full control of the company was handed ove r t o Br y s Group . LBPPL retained 90 per cent of Neo (see table-A2). On the MCA web site, there is no disclosure on classifica- tion of shares. The company has stated that it has got "all the rights for construc- tion on said plot of land for control of the company was handed over toATSHousing. Interestingly, in August 2017 ATSHousing applied as a promoter for registration and registered the project Golf Pristine Phase-II (aka ATS Pristine) with UP RERA on this plot, though on the records of the Noida Authority, the plot of land continued to be with AIPL. UP RERA has therefore registered the project inperfunctorymanner. The C&AG in its performance audit report has reported that the residential project on this plot was given part completion certificate, though none of the sports infra- structure in the entire project was completed. The Phase II was still ongoing, though RERA inspection team in May 2022 had observed that validity of the sanctioned plan has already expired in September 2020. This arrangement in clandestine manner with ATS Housing was done apparently to circumvent the terms of allotment under which the shareholding of at least 30 per cent in the company was required to be A2.
