It is understood that Logix Infra has sub-leased/ assigned the project to Goodliving Infrastructure Pvt Ltd, an associ- ate company of the Bhutani Group in August 2021 in violation of section 15 of the Real Estate (Reg- ulation and Development) Act 2016 which prohibits the pro- moter from transferring or assigning their rights or liabilities in respect of a registered project to a third party without obtaining the prior written approval of RERA. The matter was brought to the attention of chairman, UP RERA a month ago, but he chose not to respond. UP-RERA failed to detect the caveats / limitations on 70 per cent of Sports City plot, endangering the interests of Home-buyers Section 4 (2) (l) of the Real Estate (Regulation and Develop- ment) Act 2016 enjoins upon all promoters to submit an affidavit along with their application for registration of the projects stating - (A) that he has a legal title to the land on which the develop- ment is proposed along with legally valid documents with authentication of such title, if such land is owned by another person; (B) that the land is free from all encumbrances, or as the case may be details of the encum- brances on such land includ- ing any rights, title, interest or name of any party in or over such land alongwith details. Though the brochure/ lease/ sub-lease deeds stipulated that 70 per cent area of the plot would be used for recreational, institu- tional and other facilities, UP RERA has not taken cognizance of
