Plot No. 2/140A, Noida for IT/ITES sector www.infralive.com 30 Infra LIVE August 15, 2022 Uttar Pradesh MDIPL had pro- p o s e d c omme r c i a l F AR o f 54,005.70 sqm, which was 150 per cent more than what was approved by theNoidaAuthority. MDIPL also gave wrong tower- wise details (scan-D2 at pg 31) which is reflected in the terms of reference (TOR) issued by SEIAA, UP for preparation of EIA on December 28, 2018 was also not in conformity with the sanctioned plan approved by the Noida Authority. Thus, it is evident that MDIPL has furnished patently false information to SEIAA, UP though they had submitted an affidavit for the correctness of the information furnished by them. Based on the false information, SEIAA vide its letter July 16, 2019 gave environmental clearance (scan-D3 at pg 31). Circumstances under which MDIPL didn't inform the correct position in respect of approved area for the commercial usage in the IT/ITES project by the Noida Authority to SEIAAwas called from Bhutani Group but the reply is still awaited. The matter has also been taken with the Member Secretary, SEIAA regarding inconsistencies in respect of the proposed area for commercial usage in the project. Their reply is also awaited. But, it is learnt SEIAA has referred the matter to SEAC-1 for their evalua- tion. Thus, environmental clearance letter issued by SEIAA needs to be modified and directors of MDIPL are required to be heavily penalized dictory filings and approvals with respect to commercial FAR areas: In Sanctioned Plan it is 21,600 sqm; 54,005 sqm; 108,800 sqm in UP-RERA. These details have been summarized in tables-3A&3B at pg 27. 7A. NoidaAuthority On December 26, 2018, the p l anning wing o f the No ida Authority sanctioned the plan of MDIPL for this industrial plot No.2, Sector-140A, Noida. In this, commercial FAR is 21,760 sqm, which is well within the 10 per cent cap (scan-D1 at pg 30). 7B.
