Al lotment to compani es which were not even incorpo- rated The brochure condition pro- vided that allotment of land would be made in favour of an entity con- stituted and incorporated in India and the annexure to the brochure required submission of registra- tion certificate of incorporation. A plot measuring 10,064 sqm (FH-08/128) was allotted (March 26, 2010) to Hilsun Estates Pvt Ltd. However, it was found that Hilsun signed the application form on May 19, 2009 but the date was concealed intentionally by using whitener. In the bank draft attached to the application, draft serial number and date were also concealed by using whitener and a new date and number was written. The bank verified the signature and photograph on the application form of the allottee on May 20, 2009. Incidentally, Hilsun was incorporated as a company on September 18, 2009. This shows that the company was not even incorporated till the date of sub- mission of allotment form. Hence, the application for allotment should have been treated as null and void but NOIDA failed to ver- ify the same and allotted the plot. Moreover, PPL Farms Pvt Ltd (FH-07/167) and Hilsun has the same directors as Purshotam Lal andPunamLal. Similarly, Growell Services Pvt Ltd was allotted Farm House Plot FH-14 in sector 133 on February 26, 2009 but the company was incorporated on April 23, 2009. Noida Authority did not verify the fact prior to the allotment of plot. It may also be noted that PPL Firm Pvt Ltd and Integrity Infra- structure Pvt Ltd had applied for plot onMarch 24, 2011 (Thursday) and March 25, 2011 (Friday), respectively. Within a few working hours, the two applicants were allotted plots onMarch 30, 2011. Terms & conditions diluted post allotment As per terms of the brochure, the allottee/ lessee had to commence construction within six months of taking over the possession of the plot, complete construction equiva- lent to at least the prescribed mini- mum percentage of the maximum permissible covered area and obtain “functional certificate” from Noida Authority within three years from the date of handing over of actual possession of the plot by the Author- ity. However, the condition of obtaining functional certificate before transfer of plot was diluted vide the Board order dated Febru- ary 20, 2009 which permitted sale and purchase of land without con- struction. This defeated the purpose of allotment and extended the benefit to the allottee for transfer of plot without carrying out any project activities. Even after lapse of more than eight years, only two plots could be made functional as of March 31, 2020. The dilution of the clause requiring functional certifi- cate for transfer resulted in non- execution of the projects of farm houses. Plots to affluent at highly sub- sidised rate As per clause 17.5 of the Zoning Regulations of Regional Plan 2021, the farm houses were to be permit- ted outside abadi area. However, the farm houses plots were located opposite and adjacent to fully devel- oped Sectors 126 and 127. This is shown in the pictures of the map and image of 2008 obtained from Remote Sensing centre of ISRO, as shown in the CAG's Audit Report. Such plots would command high premium, particularly in most cases, they were nearby and adja- cent to the Expressway. Further, the basic rate notified by Noida Authority for the year 2008- 09 after considering land acquisi- tion cost, interest cost, internal development cost, external devel- opment cost, maintenance cost and other costs was Rs 14,400 per sqm. Sunil Chopra & Group Companies Three Farm House Plots were allotted to Sunil Chopra (FH- 09/162), promoter of Windsor pro- jects, Dyna Infosoft Pvt Ltd (FH- 03/133) and Apra Motels Pvt Ltd (FH-03/128). 9. Gurinder Jit Singh An individual Gurinder Jit Singh was allotted three plots of Farm Houses - FH-30, 31 & 32 in Sector- 128 - on the same day ie March 26, 2010, extending undue benefits of Rs 42.27 crores, as determined by the CAG, to a private individual. 10. Officer'swife Two plots (FH-04 & 05 in Sector 165) went to Unnati Infratech Pvt Ltd whose director and promoter is Alka Vikram, wife of Lalit Vikram Basantwani, who was the then Gen- eral Manager (Finance) of the Greater Noida Industrial Develop- ment Author i ty and Yamuna Expressway Authority. 11. Wife of BSPMP A plot (FH-04/126) was allotted to Alka Das, wife of Akhilesh Das Gupta who was the then Bahujan Samaj Party (BSP) Rajya Sabha Member Parliament. 12. Other prominent allottees Among the other beneficiaries of the scheme, prominent lawyers including former ASG Vikas Singh (FH-07/162), HCL Ex-CEO Vineet Nayar (FH-07/131) etc were also included. In addition, 17 companies were allotted two plots each during 2009- 2011. Besides, 33 individuals each were allotted a plot of farm house. The remaining 104 plots were allot- ted to 104 companies during 2009- 2014, out of which 103 plots were
